Terms of Service

Agreement

These Terms of Service ("Terms") are an agreement between you and TecDeon, Inc. ("TecDeon", "we", "us"), which operates Lumka at lumka.ai ("Lumka"). By using Lumka you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Lumka.

Who can use Lumka

You must be at least 18 years old and able to enter into a binding contract to use Lumka. You may not use Lumka if the law where you live does not allow it or if we have previously suspended your access.

Your account

Some features, such as the Generator, require you to sign in. You are responsible for keeping your account secure and for everything that happens under it. Keep your account information accurate, do not share your sign-in with anyone, and tell us right away at [email protected] if you think someone else has used your account.

Watching Dramas

The AI short dramas on Lumka ("Dramas") and their Episodes are made by the Lumka team and are owned by us or our licensors. You may stream them on Lumka for your own personal, non-commercial viewing and share links to their pages. You may not download, record, copy, re-upload or redistribute Dramas, or access their video files other than through the Lumka player. We may add, change or remove Dramas and Episodes at any time.

Creating with the Generator

The Generator lets you describe a story idea and, where available, add your own material ("Inputs"). Lumka AI then generates a video ("Creation"). Creations are private to your account; we do not show them in the Showcase or to other users. Because Creations are generated automatically, they may be inaccurate, unexpected or similar to content made for other people, and we do not guarantee that any Creation will be unique or fit a particular purpose.

Your Inputs and Creations

You keep the rights you have in your Inputs. As between you and us, you own your Creations to the extent the law allows, subject to these Terms. You give us a worldwide, non-exclusive, royalty-free licence to host, store, process and display your Inputs and Creations only as needed to operate, provide and secure Lumka and to comply with the law. You confirm that you have all the rights needed to submit your Inputs and that your Inputs and Creations do not break these Terms or anyone else's rights.

Content rules

Lumka is a general-audience entertainment service. You must not use Lumka to create, upload or share content that:

  • is sexual or sexually suggestive, or involves minors in any sexual, abusive or harmful way;
  • depicts or imitates a real person, including their face, body or voice, without their permission, or impersonates anyone;
  • harasses, threatens, bullies or promotes hatred or violence against any person or group;
  • infringes copyright, trademark, privacy, publicity or other rights;
  • is illegal, promotes illegal activity, or is presented as real footage of real people or events.

You also must not:

  • use bots, scrapers or other automated means to access Lumka or its media;
  • get around access controls, playback protections or media links, or share links that give others access to paid content;
  • copy, modify, reverse engineer or resell Lumka or any part of it;
  • interfere with Lumka's operation or security, or try to access accounts or systems you are not allowed to access.

We may remove content and limit or end access to Lumka when we believe these rules have been broken.

Paid features

Some features may require payment. Before you buy, we will show you the price, what you get and whether anything renews automatically. If a plan renews automatically, you can cancel before the next renewal date and keep access until the end of the period you paid for. Payments are processed by our payment providers. Except where the law requires otherwise, payments are non-refundable. We may change prices for future purchases; changes will not affect anything you have already paid for.

Copyright complaints

If you believe content on Lumka infringes your copyright, email [email protected] with: your contact details; a description of the work; the link to the content on Lumka; a statement that you believe in good faith the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for the owner; and your physical or electronic signature. We will review notices, remove infringing content and end the accounts of repeat infringers where appropriate.

Our rights in Lumka

Lumka, including its software, design, logos and the Dramas we publish, is protected by intellectual property laws and belongs to us or our licensors. These Terms do not give you any rights in Lumka other than the limited right to use it as these Terms allow.

Disclaimers

Lumka is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that Lumka will be uninterrupted, error-free or always available, or that Creations will meet your expectations.

Limitation of liability

To the fullest extent the law allows, TecDeon and its affiliates, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of Lumka. Our total liability for any claim relating to Lumka is limited to the greater of the amount you paid us in the 12 months before the claim or US$100.

Indemnity

You agree to defend and indemnify TecDeon against claims, losses and costs, including reasonable legal fees, that arise from your Inputs, your Creations or your breach of these Terms.

Suspension and termination

You can stop using Lumka at any time and ask us to delete your account by emailing [email protected]. We may suspend or end your access at any time if you break these Terms, if the law requires it, or to protect Lumka, our users or others. Sections that by their nature should survive termination, including those on content rights, disclaimers, limitation of liability, indemnity and governing law, will survive.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law rules. Any dispute relating to these Terms or Lumka will be heard in the state or federal courts located in Delaware, and you and we consent to their jurisdiction. Nothing in these Terms takes away rights you have under the mandatory consumer protection laws of the country where you live.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the date at the top of this page, and for material changes we will give notice on Lumka or by email before they take effect. If you keep using Lumka after changes take effect, you accept the updated Terms.
